70 A No, sir, I personally did not and I don't know of any tommy gun being present. There might have been, but I don't know.

71 Q My question also included a caliber forty-five pistol?

A That is right. No, sir. I didn't fire a shot from any weapon at that time.

72 Q Did you or any of your men fire a carbine at these SS troopers?

A I think one of my men fired a carbine when they started to rush the gun. I wouldn't swear on it. I just think carbines were fired.

73 Q Was there any effort to rush the gun before the shooting of some of the prisoners?

A There was a movement toward the original four guards. There was no shooting up to the time the machine gun was brought in. There was a movement toward the guards from the right flank before the machine gun was called in. As I said before I sent for the machine gun and set it up, but up to that time no shots were fired.

74 Q I picked up at this location a number of empty carbine cartridges and a number of 45 caliber shells and some 45-caliber slugs, which had blood on them. Do you remember who fired the carbine or who fired 45-caliber ammunition?

A I am almost positive that none of my men were armed with 45's or tommy guns, and I am almost positive that none were fired at that time.

75 Q How about carbines?

A I think one of the guards was armed with a carbine and did fire.

76 Q Was the platoon leader of the first platoon present when this occurred?

A I don't believe so, sir.

77 Q What is his name?

A Lt. Strickland.

78 Q Was the platoon sergeant present?

A I don't think so.
